Winston K. Fogarty

Winston Fogarty is the Managing Partner of the Ottawa office of an international law firm with over 20 offices world-wide and serves as Senior Advisor to SIRA.

Winston was a founding partner with Regent Law which merged with his current firm in 2018. Winston’s practice at Regent focused on commercial litigation, competition law, government affairs, trade law, Bankruptcy and Insolvency Act (BIA) issues related to fraudulent transactions, and cross-border civil claims involving the enforcement of letters rogatory.

Mr. Fogarty commenced his legal career in the Federal Department of Justice (DOJ). He completed his career in 2014 as Executive Director and Acting Senior General Counsel, in the DOJ Legal Services Unit at the Department of Foreign Affairs, and Trade and Development (Global Affairs Canada).

Previously, he served in senior management positions as the Executive Director and General Counsel of the DOJ Units at the former Canadian International Development Agency (CIDA); Foreign Affairs and International Trade (DFAIT); and the Royal Canadian Mounted Police (RCMP).

In the formative stages of his career, Winston was a Crown prosecutor and advocated a plethora of charges that our national police force laid under the Criminal Code and federal regulatory statutes under its contract policing role both in the trial and appellate courts. He has been immersed in the police culture and is knowledgeable of the rigorous standards and procedures that law enforcement must follow as part of their investigative mandate, having been an advisor and integral member of the RCMP’s Executive Committee.

In mid-career, Winston held senior counsel positions while representing the Attorney General of Canada in the conduct of litigation under the Competition Act and at the Canadian Security Intelligence Service in respect of national security certificate cases before the Federal Court.

He is recognized for his skills as a trial counsel and negotiator. His training at the Harvard Law School focused on the fields of negotiation, advanced negotiation, and mediation, in alternative dispute resolution. He holds a Master of Laws degree from the London School of Economics and Political Science.
